Joburg to repeal private CCTV By-law

The City of Johannesburg intends to repeal its Privately-Owned Closed Circuit Television Surveillance Camera Bylaw adopted in late February 2025 following legal action brought by SAPOA.

The Bylaw requires property owners to register all CCTV camera systems operational within the city and which have an angle view to all public spaces. It also requires property owners to annually renew approval (with costs incurred) and to adhere to regular inspections of all CCTV cameras by City officials. The footage may only also only be released to SAPS and JMPD and may no longer be shared by property owners or security providers.

In May 2025, SAPOA instituted court proceedings to have the Bylaw declared unconstitutional and unlawful.

Subsequently, the City’s attorneys have notified SAPOA that it intends to repeal the Bylaw at its next Municipal Council at the end of August 2025, advising that the necessary resolution is being tabled to effect such a repeal.

SAPOA has noted this intention with appreciation. It is appreciative of the fact that the City has seemingly realised the errors it committed. Having said that, SAPOA’s application will only be removed from the court roll once the Bylaw has in fact been repealed, and its legal costs had been paid,” says SAPOA CEO, Neil Gopal.

SAPOA will continue to monitor the situation closely and we will advise members once the Bylaw has in fact been repealed.”
